It explores and explains why there are currently more than 360,000 cases of murder that remain unresolved in criminal justice systems around the world—and it makes a strong case for greater public attention and resources being directed towards these issues.
Our main message is this: our current methods do not work well enough to deliver truly fair and efficient solutions on an acceptable scale, so they need radical change if we are serious about reducing the number of unresolved cases and improving overall justice outcomes for all citizens across the globe.
In this book we also make a strong case for the use of Artificial Intelligence (AI) to help address these problems in new ways:
- In criminal trials, AI could be used to analyse large volumes of evidence and test its reliability against each other;
- It could support judges by highlighting key information from cases, enabling them to make more informed decisions on verdicts and sentences;
- AI can be applied to predict the outcomes of cases accurately at court hearings (judgements); and
- We also explore how new digital tools might help solve some crimes by improving existing police investigation methods.
We believe that these are just some of the ways in which Artificial Intelligence may play a useful role in tackling unresolved cases—if it’s implemented well, with appropriate oversight and human control. The book also looks at what this might mean for people who come into contact with the criminal justice system:
- Will AI help to prevent more crimes? Or will it become another tool of oppression and injustice against already disadvantaged communities (such as those with a history of institutional racism)?
- What does it actually cost—financially, socially and ethically—for criminal justice systems around the world to solve thousands more cases each year?
- And perhaps most importantly, what are our moral obligations when we introduce new technologies like AI into an area that already suffers from so much human error?
These questions provide a framework for you to consider as we explore how Artificial Intelligence can be used in different areas of criminal justice—and whether it has the potential to bring about significant change. Throughout, our goal is to make clear both the benefits and risks that may come with using new technologies such as AI, so that citizens, politicians, decision makers and society at large can engage critically in the debate about their implementation.
Our aim here is not to offer an exhaustive exploration of these questions—the book simply sets out a framework for how we might do this across the different areas where AI could be used to help address unresolved cases, while also considering wider criminal justice issues:
- From crime prevention and detection at its most fundamental level in police investigations; through identifying potential suspects based on biometric data (e.g., facial recognition); up to court hearings where verdicts and sentences are reached by judges after hearing evidence, including witness testimony (which is often subjective).
- Our focus here is not just on AI’s current state or its possible future development in this field—it also explores a range of potential risks associated with using the technology in criminal justice, such as bias and discrimination. It’s worth emphasising that we believe it may be possible to mitigate some of these risks through better design choices; careful oversight (which should involve external experts); and making sure there are appropriate human controls over the technology.
We also consider how AI might support public attitudes towards criminal justice, such as by improving accessibility for citizens seeking information on current cases, or providing a forum where communities can express their views about proposed changes to policing methods. And of course, it’s vital that any use of new technologies in this context doesn’t result in further marginalisation; instead, they should help make the criminal justice system fairer and more accessible for everyone—including those who have suffered unjustly in past generations (such as indigenous populations).
Ultimately our goal with this book is to present a comprehensive analysis of all these issues so that informed public debate can begin around how best we might deploy Artificial Intelligence within criminal justice systems while protecting individual rights and improving outcomes. We hope it will lead to meaningful change in both law enforcement methods worldwide—and provide new tools for solving some of the thousands more cases which remain unsolved today.
